Vision Planning was instructed in early 2020 to advise a client in Oxford on the lawfulness of a breach of a planning condition restricting the use of an annex as a separate dwelling.

The annex was permitted in 2009, and had been built, but had been used a dwelling separate from the main house.

Vision Planninng submitted a certificate of lawfulness with a good deal of evidence to demonstrate that the breach had occurred for more than 4 years (in some cases it needs to be ten years thought so please seek advice first).

In October 2020, the local Council agreed that the annex is now a separate dwelling and can therefore be rented out or sold separately.
