In January 2023, Vision Planning obtained a lawful development certificate which enabled a farmer to use a house with an agricultural tie to be used as a separate dwelling.
The Owls was originally permitted at Court Barn Farm as an agricultural worker’s dwelling, but was not actually occupied by an agricultural worker for more than 10 years.
Where a breach of planning control like this occurs, the breach can become lawful after either 4 or 10 years, and a certificate of lawful existing use or development is the formal process to demonstrate this lawfulness.
We worked with the farmer to compile plenty of evidence of demonstrate that the agricultural tie had been breached for long enough, and the Council issued a certificate of lawfulness confirming that The Owls is now a lawfully a separate dwelling that can be rented or sold like any other dwelling.
