In February 2024, Vision Planning obtained a certificate of lawfulness to enable an annex to be used as a separate dwelling.
The client had been letting out their annex as a holiday let via Air BnB for more than 4 years.
The annexe was originally a garage, but planning permission was granted in 2016 to turn the garage into a “self-contained annex” with a condition requiring the annex to “only be used as ancillary accommodation”.
Vision Planning successfully argued that the use of the annex for holiday lets was a breach of the condition, and that this had taken place continuously for more than 4 years, so the Council issued the certificate of lawfulness.
This means that the annex is now lawfully a separate dwelling.
